Context
Mohamed Hussein Ali, former Commissioner of Police of Kenya, was summoned to appear before the ICC in relation to the 2007–2008 post-election violence. He was alleged to have contributed to crimes against humanity through his role in state security structures. On 23 January 2012, Pre-Trial Chamber II declined to confirm the charges, finding that the evidence did not establish substantial grounds to believe that he was criminally responsible for the alleged crimes.
